Terms of Service

By accessing or using Serrét ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including individual users and organizations ("Subscribers").

Serrét is a business suite platform that provides:

• Customer Relationship Management (CRM) tools • Product comparison and recommendation engine • Sales tracking and commission management • Team wellness and productivity features • Analytics and reporting tools • Calendar and scheduling integration • AI-powered assistance

The Service is provided on a subscription basis with different tiers (Essentials, Professional, Enterprise) offering varying features and capabilities.

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Maintain the security of your password and accept responsibility for all activities under your account • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

Subscription Plans: The Service offers monthly and annual subscription plans. Features vary by plan tier.

Billing: Subscriptions are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees due.

Onboarding: Customers can choose Guided DIY (free, self-paced with async support) or an Accelerator program ($1,000-$10,000 based on engagement length) for hands-on assistance. 100% of any Accelerator fee goes toward the first-year subscription if you continue.

Price Changes: We may modify pricing with 30 days' notice. Existing subscriptions will honor current pricing until the next renewal period.

Refunds: We offer a 30-day money-back guarantee for annual subscriptions. Monthly subscriptions are non-refundable but can be cancelled at any time.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws • Attempt to gain unauthorized access to any portion of the Service • Interfere with or disrupt the integrity or performance of the Service • Upload malicious code, viruses, or harmful data • Harvest or collect information about other users without consent • Impersonate any person or entity • Use the Service to send spam or unsolicited communications • Reverse engineer, decompile, or attempt to extract source code • Resell or redistribute the Service without authorization

Violation of these terms may result in immediate termination of your account.

Ownership: You retain all rights to data you upload to the Service ("Your Data"). We do not claim ownership of Your Data.

License: You grant us a limited license to use, store, and process Your Data solely to provide the Service.

Responsibility: You are responsible for the accuracy, quality, and legality of Your Data and how you obtained it.

Backup: While we maintain backups, we recommend you export and maintain your own copies of important data.

Deletion: Upon account termination, Your Data will be deleted within 90 days, except as required by law or for legitimate business purposes (fraud prevention, legal compliance).

Our IP: The Service, including its original content, features, and functionality, is owned by Serrét Pty Ltd and protected by international copyright, trademark, and other intellectual property laws.

Trademarks: "Serrét", our logo, and related marks are trademarks of Serrét Pty Ltd. You may not use these without our prior written consent.

Feedback: Any feedback, suggestions, or improvements you provide may be used by us without obligation to you.

The Service may integrate with or contain links to third-party services (e.g., Stripe for payments, Google Calendar for scheduling). We are not responsible for:

• The content, policies, or practices of third-party services • Any damage or loss caused by your use of third-party services • The availability or reliability of third-party services

Your use of third-party services is governed by their respective terms and privacy policies.

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide reasonable notice) • Emergency maintenance or security updates • Circumstances beyond our reasonable control

We target 99.9% uptime and will communicate any significant outages through our status page.

To the maximum extent permitted by law:

• The Service is provided "AS IS" without warranties of any kind • We are not liable for any indirect, incidental, special, consequential, or punitive damages • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim • We are not liable for any loss of data, profits, or business opportunities

Some jurisdictions do not allow the exclusion of certain warranties or limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Serrét Pty Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service • Your violation of these Terms • Your violation of any rights of a third party • Your Data or content you submit to the Service

By You: You may terminate your account at any time through account settings or by contacting support.

By Us: We may suspend or terminate your access immediately, without prior notice, for:

• Violation of these Terms • Non-payment of fees • Conduct that harms other users or the Service • Legal or regulatory requirements

Effect of Termination: Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive (including ownership, liability, and indemnification).

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on this page • Updating the "Last updated" date • Sending email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the new Terms. If you disagree with changes, you must stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved in the courts of New South Wales, Australia. You consent to the exclusive jurisdiction of these courts.
